1. Acceptance of Terms
By accessing or using MindList (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and MindList ("we", "us", or "our").
2. Description of Service
MindList is a productivity application that allows you to create, organize, and manage outlines and notes. The Service includes real-time synchronization across devices, offline access, and collaboration features.
3. Account Registration
To use the Service, you must create an account using a valid email address or by signing in with Google. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
4. User Content
You retain all ownership rights to the content you create in MindList. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing and improving the Service.
You agree not to upload or create content that:
- Violates any applicable law or regulation
- Infringes on the intellectual property rights of others
- Contains malicious code, viruses, or harmful data
- Is abusive, harassing, or otherwise objectionable
5. Acceptable Use
You agree to use the Service only for its intended purpose. You may not:
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to transmit spam or unsolicited communications
- Interfere with or disrupt the integrity or performance of the Service
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service in any manner that could damage, disable, or impair it
- Use automated means to access the Service without our written consent
6. Subscriptions and Payments
MindList offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis, as chosen at the time of purchase. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.
7. Intellectual Property
The Service, including its design, logos, code, and documentation, is owned by MindList and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
9. Service Availability
We strive to keep MindList available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.
10. Termination
You may terminate your account at any time by deleting it from the Settings page. We reserve the right to suspend or terminate your access to the Service if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, secure, or available at all times. You use the Service at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, MindList shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
13. Indemnification
You agree to indemnify and hold harmless MindList, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or your violation of these Terms.
14. Changes to Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
